PixPunch Terms & Conditions

1. Acceptance of Terms
Before you create an account with PixPunch (herein referred to as "we," "us," or "PixPunch"), please read these Terms of Use ("Terms") carefully. These Terms govern your access to and use of PixPunch’s services ("Service"). By clicking the "Sign Up" button, you acknowledge and agree to these Terms, forming a legally binding agreement between you and PixPunch. If you do not agree with these Terms, please click "Cancel." Any violation of these Terms may result in the termination of your access to our Service.

2. Copyright Protection & Intellectual Property
PixPunch is committed to protecting photographers' copyrights and expects users to do the same. You must own or obtain permission to use any image before uploading or printing it through PixPunch. In accordance with copyright laws, PixPunch may, at its discretion, terminate the accounts of users who infringe on intellectual property rights. If you believe your copyrighted work has been used unlawfully, please contact us at nitin@PixPunch.com.

3. User Responsibilities

• You agree to use the Service responsibly and in compliance with all applicable laws.

• You must not upload, share, or distribute any content that is unlawful, defamatory, obscene, or otherwise inappropriate.

• You retain ownership of your images but grant PixPunch a limited, non-exclusive license to process, store, and display them as necessary to provide the Service.

4. Payment & Pricing

• PixPunch offers various pricing models, including per-image payments and hourly editor hiring.

• All payments must be made through approved payment methods.

• PixPunch reserves the right to modify pricing at any time, with prior notice.

5. Service Availability & Termination

• PixPunch aims to provide uninterrupted service but does not guarantee 100% uptime.

• We reserve the right to suspend or terminate your account if you violate these Terms.

6. Refund Policy
PixPunch returns the images to You via public web address (e.g., URL). Although PixPunch utilizes means to make Your edited image available only to You, there are inherent security limitations in a public web address which PixPunch cannot and will not rectify and for which PixPunch will not be liable. You are able to retrieve your edited images by downloading them from PixPunch's website, and in addition PixPunch may permit retrieval through an FTP server, API, or other mechanism.

PixPunch offers different service pricing based on different requested delivery dates. PixPunch prioritizes its orders based on requested delivery dates and recognizes that PixPunch will have satisfied and returning customers if it meets the requested delivery dates. PixPunch will use commercially reasonable efforts to deliver Your image within the time frame requested, but PixPunch does not guarantee that an order will meet its requested delivery date. If on the actual date PixPunch returns Your edited images is in a different delivery tier from the price You paid (e.g., You paid for 24-hour service but PixPunch returned the image within 72 hours), You may contact PixPunch through your account page, detail the date ordered, the requested delivery date, and the date actually delivered, and PixPunch will refund any difference as if You had requested the delivery date in which PixPunch actually delivered the edited image. In rare instances, particularly large orders may surpass PixPunch processing capacity for a requested delivery date, in which case PixPunch will contact You to determine how best to restructure Your order.

This Agreement shall be effective from the date You submit an image to PixPunch until the date the returned image is deemed accepted, provided that PixPunch may terminate this Agreement at any time and will return the fees paid by You for any image that PixPunch has not edited and PixPunch may or may not in PixPunch’s sole discretion return fees paid for edited images not yet deemed accepted. Sections 3-9 of these Terms of Services, and any other provisions by their very nature, shall survive the expiration or termination of this Agreement.

7. Changes to Terms
PixPunch reserves the right to modify these Terms periodically. By continuing to use our Service after any updates, you agree to be bound by the revised Terms.
